1 What is i-Cash?
i-Cash is a payment service which allows you to exchange cash for a voucher with a unique PIN, which can be used to make a payment online.
2 How does i-Cash work?
When you present a valid i-Cash PIN for payment at a Partner Merchant website, i-Cash verifies that the voucher has sufficient value and confirms your payment by deducting your payment amount from the value of the voucher.
3 How do I get i-Cash?
At your nearest i-Cash reseller. For more info, visit the “Where to Get” page.
4 Where can I spend i-Cash?
At any Partner Merchant website. For more info, visit the “Where to Spend” page.
5 When do these Terms and Conditions start?
By purchasing an i-Cash voucher you agree to be bound by the Terms and Conditions set out in this Agreement.
6 Getting i-Cash legally
i-Cash is not liable for the validity of any voucher PINs obtained from anyone who is not listed as a i-Cash reseller on the “Where to Get” page.
7 When do these Terms and Conditions end?
You cease to be an Owner of a i-Cash voucher when you use the voucher, supply the unique PIN to another individual or it expires.
9 Keeping i-Cash PINs safe
You are responsible for keeping your i-Cash voucher PIN details safe. You accept that i-Cash is entitled to process a payment via a Partner Merchant website without knowing the identity or entitlement of the Owner of the i-Cash voucher.
1 Acceptance of Terms & Conditions
1.1 These terms and conditions of usage constitute the agreement between you and Payallo Ltd relating to your use of the i-Cash payment service (the "Agreement").
1.2 Payallo Ltd reserves the right to alter these terms and conditions from time to time by posting notice of any changes on its website www.payallo.com and www.i-cash.com. Any changes will take effect 1 month after the date of posting on the website, and shall apply to your use of the i-Cash payment service after that 1 month period.
1.3 By owning a i-Cash voucher you agree to be bound by the terms and conditions set out in this Agreement in relation to any use of the i-Cash payment service.
1.4 You become an Owner of a i-Cash voucher by:
1.4.1 Obtaining a voucher from a reseller contracted to issue i-Cash vouchers; or
1.4.2 Being gifted a i-Cash voucher and being in receipt of proof of purchase including the original voucher.
1.5 You cease to be an Owner of a i-Cash voucher when:
1.5.1 You submit the voucher PIN and amount to a Partner Merchant for validation for payment by i-Cash and the voucher is depleted; or
1.5.2 You use Manage i-Cash section to manage that voucher PIN as a result of which a new voucher PIN is issued to you; or
1.5.3 Another person becomes the Owner of that voucher.
1.6 This Agreement terminates automatically:
1.6.1 When you cease to be an Owner; or
1.6.2 When the i-Cash voucher PIN expires.
1.7 We reserve the right to refuse to validate a i-Cash voucher PIN and amount if we have reason to suspect that any breach of any applicable law or regulation has occurred or is likely to occur.
1.8 You agree that you will not use the i-Cash payments service for any illegal purpose.
1.9 You agree that you will keep proof of purchase of the i-Cash voucher PIN including the original voucher receipt and that this proof of purchase may be requested by i-Cash payment service to establish that you are the Owner of the i-Cash voucher PIN as defined in 1.4.
2 Getting a i-Cash voucher
2.1 i-Cash voucher PINs are issued by companies contracted as resellers with Payallo Ltd.
2.2 Such resellers may use retailers and other distributors to issue i-Cash voucher PINs.
2.3 Contracted resellers are listed on the website www.i-cash.com and you should satisfy yourself that any company purporting to issue i-Cash to you is a contracted reseller.
2.4 Payallo Ltd is not liable for the validity of any voucher PINs originating from any person who is not a Payallo Ltd contracted reseller or for any losses or damages resulting from the supply of voucher PINs from any such persons (whether such voucher PIN is supplied direct to you or obtained by you in the manner described in section 1.4)
3 Using a i-Cash voucher
3.1 You may use the i-Cash payments service to make payments to Partner Merchants. You will not pay any charges to Payallo Ltd for making such a payment. Partner Merchants are listed on the i-Cash website www.i-cash.com and you should satisfy yourself that a Merchant is a Partner Merchant before submitting the i-Cash voucher PIN to a Merchant as payment. Payallo Ltd is not liable for any loss under any circumstances resulting from the presentation of voucher PINs to anyone that is not a Partner Merchant.
3.2 Local regulations may limit the redemption of a i-Cash voucher PIN to only those Partner Merchants operating within the country where the i-Cash voucher PIN was issued and this will be stated at www.i-cash.com. You should satisfy yourself that a Partner Merchant can accept a i-Cash voucher PIN issued in your country before submitting the i-Cash voucher PIN to the Partner Merchant.
3.3 Upon submission by you of the i-Cash voucher PIN and face value of the i-Cash voucher to the Partner Merchant, and the presentation by the Partner Merchant to i-Cash payment service of the i-Cash voucher PIN and face value of the i-Cash voucher, i-Cash payment service will validate the voucher PIN details and will advise the Partner Merchant of the validity or otherwise of the submission.
3.4 In the event that i-Cash payment service shall advise the Partner Merchant that the submission is valid, the Partner Merchant may accept such advice and proceed to accept the i-Cash voucher as payment.
3.5 If i-Cash advises the Partner Merchant that the submission could not be validated, then the Partner Merchant will advise you accordingly.
3.6 i-Cash voucher PINs are unique 12-digit numbers. Each number applies to a single voucher PIN for a single stated face value amount and currency. If a voucher PIN and amount submitted to i-Cash for validation matches our issuing records, i-Cash shall be entitled to confirm such validation to the Partner Merchant. i-Cash shall not be obliged to undertake any verification of the identity of the person submitting the voucher PIN and amount for validation but shall be entitled to rely on the act of submission as a warranty that you are the legitimate Owner of the voucher PIN and entitled to use it.
3.7 i-Cash only provides payment services, and has no involvement in any contract or other dealings you have with the Partner Merchant. i-Cash shall not be liable in any way under the terms of that contract or other dealings or in any way arising therefrom.
3.8 Once i-Cash payment service has advised a Partner Merchant that a submitted voucher PIN and amount are verified, i-Cash payment service has no means of subsequently withdrawing such use and the voucher PIN and amount will be considered redeemed and will be permanently deducted from the value of the voucher.
3.9 Any refund of a payment resulting from a claim against a Partner Merchant is subject to the Partner Merchant's own terms and conditions of business and refund policy. You should make yourself aware of such terms and policies before using a i-Cash voucher to pay a Partner Merchant.
4 Security of your i-Cash voucher PIN
4.1 You are solely responsible for the security and integrity of your i-Cash voucher PIN. You acknowledge that Payallo is entitled to act on any request submitted through a Partner Merchant website for validation without enquiry into the identity or entitlement of the Owner.
4.2 i-Cash payment service shall not be obliged to verify that the person presenting the voucher PIN and amount to i-Cash payment service via a Partner Merchant is the Owner of, or is otherwise entitled to use, the i-Cash voucher PIN.
5 Manage i-Cash
5.1 The “Manage i-Cash” section exists to help you use and manage your i-Cash voucher PINs . “Manage i-Cash” is provided for the convenience of Owners of i-Cash voucher PINs as defined in section 1.4. Access to “Manage i-Cash” may be restricted without notice at the complete and sole discretion of Payallo Ltd and Payallo Ltd will have no liability whatsoever for any damages or losses arising as a result thereof. i-Cash voucher PINs created via “Manage i-Cash” will be blocked if:
5.1.1 there is suspicion of unauthorised use for trade purposes; or
5.1.2 there is suspicion of fraudulent or criminal activity taking place; or
5.2 If i-Cash reasonably suspects that you are in breach of any part of section 9.1 or that you have redeemed or attempted to redeem a voucher PIN originating from any person who is not a Payallo Ltd contracted reseller then i-Cash payment service reserves the right to permanently invalidate this voucher and any other i-Cash voucher supplied to or held by you (whether or not any such other vouchers originate from a person who is not a i-Cash contracted reseller). In these circumstances you must contact i-Cash customer service as soon as possible in order to verify that all activity in relation to all your vouchers is authorised, lawful, and in accordance with this Agreement. i-Cash payment service will issue new voucher PINs to you for the same value as your invalidated vouchers only if you can prove that you have acted lawfully and in accordance with this Agreement in every respect. Your failure to do so will lead to the value of all your affected vouchers being permanently forfeited.
5.3 You agree that should further identification and/or verification be required to perform or complete “Manage i-Cash” transactions, you give your consent that i-Cash payment service has the right to perform such KYC (Know Your Customer) checks deemed necessary to comply with Anti Money Laundering and Regulatory requirements.

Payallo Ltd will use reasonable endeavours to minimise any periods during which the service is unavailable and where possible will post notice on its website www.payallo.com or www.i-cash.com of such suspension.

7.2 Payallo Ltd gives no warranty, makes no representation and disclaims all liability so far as the law allows with respect to the quality, availability, legality, delivery or any other aspect of your dealings with Partner Merchants.
8 Liability Limitation
8.1 You acknowledge that Payallo Ltd is solely providing a payment service and that some limitation of liability on Payallo's part is reasonable and customary in an Agreement such as this.
8.2 Accordingly, you agree that Payallo Ltd shall not be liable for:
Any validation provided by i-Cash payment service not being acted upon by a Partner Merchant for any reason;
Any delay or failure to carry out Payallo's obligations under this Agreement arising from maintenance or upgrade of the service, or failure of the service or other event beyond our reasonable control;
Any loss or damage (including direct, indirect or consequential loss or damage or loss of profits, business, revenue or opportunity) arising from any delay or failure to carry out Payallo's obligations under this Agreement, save that nothing in this Agreement shall purport to exclude or limit the liability of either party for death or personal injury caused by negligence.
8.3 Save in relation to death or personal injury caused by negligence, in no circumstances shall Payallo's liability hereunder exceed the face value of the i-Cash voucher PIN that is issued to you.
9.1 You hereby indemnify and agree at all times to hold Payallo Ltd harmless from and against all losses, demands, claims, damages, expenses (including reasonable legal costs) and liabilities arising from any third party claim resulting from your use or misuse of the i-Cash payment service, or for harm suffered directly or indirectly by Payallo Ltd as a result of your breach or non-observance of your obligations under this Agreement.

12.2 Payallo Ltd reserves the right to assign, subcontract or transfer its obligations hereunder to any third party.
12.3 Nothing in this Agreement is intended to create any rights which are enforceable by any person who is not a party to this Agreement.
12.4 If any clause or part of any clause of this Agreement shall be found to be illegal or unenforceable, then the validity and enforceability of the remainder of the Agreement shall not be adversely affected.
12.5 Any delay or failure by Payallo Ltd to enforce or pursue any remedy or right hereunder shall not be deemed to be a waiver of that remedy or right and will not prevent that right or remedy from subsequently being exercised or enforced.
12.6 This Agreement constitutes the entire agreement between us relating to the provision of the i-Cash payment service and supersedes any previous agreements and understandings between us relating thereto.
